- The evidentiary presumption of marriage has been with us for quite some time and is seemingly if not precisely, established. However, recent decisions in the Family Court of Australia have, if confusing the notion’s operation, have drawn attention to the presumption’s operation in Australia and elsewhere. These recent decisions draw special attention to the factual circumstances which can presently give rise to the presumption which help to demonstrate the need for it in today’s global circumstances.
